Please read these Terms of Service ("Terms") carefully before using the LeanMaxR mobile application ("App") operated by OnPointFresh ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using LeanMaxR, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

LeanMaxR is a fitness tracking application designed to help users monitor their weight loss progress during a "cutting phase." The App provides:

• Daily weight and measurement tracking
• Macro nutrient logging (protein, fat, calories)
• Progress photo storage
• Trend analysis and projections
• AI-powered calorie estimation and nutrition insights (requires subscription)

3. User Accounts & Data

The App does not require account registration. All your data is stored locally on your device. You are responsible for:

• Maintaining the security of your device
• Backing up your device to preserve your data
• The accuracy of information you enter

4. AI Pro Subscription

Pricing: AI Pro is available as a monthly subscription at $9.00/month (USD). Prices may vary by region.

Billing:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

Refunds: Refunds are handled by Apple according to their refund policy. We do not process refunds directly.

5. AI Features

AI-powered features (calorie estimation, nutrition insights, meal suggestions) are provided through third-party AI services. By using these features:

• You acknowledge that AI estimates are approximations and may not be completely accurate
• You agree that food photos and meal descriptions may be processed by our AI provider
• You understand that AI suggestions do not constitute medical or nutritional advice

6. Health Disclaimer

LeanMaxR is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease.

• The App provides tools for self-tracking and is for informational purposes only
• Calorie and macro calculations are estimates based on general formulas
• AI-generated nutrition information is approximate and should not replace professional advice
• Consult a healthcare provider before starting any diet or exercise program
• If you experience any health issues, seek medical attention immediately

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or hack the App
• Upload malicious content or interfere with the App's operation
• Use the AI features to generate inappropriate or harmful content
• Share your subscription with others or circumvent subscription requirements

8. Intellectual Property

The App, including its design, features, and content, is owned by OnPointFresh and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

9. Third-Party Services

The App integrates with third-party services:

• Apple Health: Optional sync is subject to Apple's terms
• Anthropic (Claude AI): AI features use Anthropic's API, subject to their terms
• Apple App Store: Purchases are subject to Apple's terms

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" without warranties of any kind
• We are not liable for any damages arising from your use of the App
• We are not responsible for decisions you make based on App data or AI suggestions
• Our total liability shall not exceed the amount you paid for the App in the past 12 months

11. Indemnification

You agree to indemnify and hold OnPointFresh harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms. We will update the "Last updated" date when changes are made.

13. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

14. Governing Law

These Terms are governed by the laws of the jurisdiction where OnPointFresh is established, without regard to conflict of law principles.

16. Apple-Specific Terms

If you are using the App on an Apple device:

• These Terms are between you and OnPointFresh, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties or claims
• Apple is not responsible for addressing any claims related to the App
• Apple is a third-party beneficiary of these Terms
